EFSMM represents clients in mass and toxic tort pattern litigation, multidistrict litigation, and stand-alone complex cases alleging exposure to chemicals, toxic materials and substances, and manufacturing byproducts. Plaintiffs in these matters allege personal injury, including allegations of cancer, reproductive toxicity, and developmental issues.

These cases can be and typically are protracted, complex, and unwieldy with rapidly evolving areas of law and science as well as novel claims by sophisticated plaintiffs’ counsel.  As a result, we work closely with experts – scientists, physicians, engineers, and economists – to articulate technical concepts and data in a simple and effective way that juries can easily understand. EFSMM attorneys can handle unique local issues (such as California’s Proposition 65) as well as coordinate defense strategy for nationwide litigation.

REPRESENTATIVE MATTERS

  • EFSMM is defending a major manufacturer of herbicides in product liability litigation related to claims of cancer. Our attorneys are trial counsel, members of coordination, strategy, and science teams, and work-up counsel.
  • EFSMM is defending a chemical manufacturer in mass tort action involving allegations of PCB exposure. Plaintiffs allege the mishandling of a variety of toxic chemicals alleged to have occurred over 70 years and purportedly injured 100s of individuals.
  • EFSMM is defending a manufacturer of an engineered fuel product in a wrongful death action involving allegations of benzene exposure.   
  • The firm has and continues to defend several aviation, piping, and automobile manufacturers in wrongful death and catastrophic injury actions involving asbestos exposure.
